State aid law

We advise both the public sector and companies on EU state aid law and national subsidy law. In particular, we provide support in the drafting of contractual provisions in compliance with state aid law, in risk assessment under state aid law and, finally, in state aid proceedings of the European Commission and in court proceedings involving matters in dispute under state aid law. In the event of the recovery of granted aid, we support the companies affected by the recovery.

A particular focus of our state aid law practice is the energy sector. Numerous state interventions in the market - the promotion of renewable energies, the relief of companies with high energy consumption from the EEG levy, the compensation of generation companies for the early exit from nuclear energy and coal-fired power generation - raise the question of whether these cases qualify as state aid and whether it is compatible with the internal market. For all these questions, we are a contact partner for energy suppliers and industrial companies.
